Terms of Service

1. The service

CreaCio PH provides AI-assisted tools that help you create marketing content for products you promote, including generated prompts, scene breakdowns, storyboard images, a content calendar, and a public bio page.

CreaCio is a content creation tool. We are not affiliated with, endorsed by, or acting on behalf of Shopee, TikTok, Lazada, Google, OpenAI or any other platform. Your obligations to those platforms are between you and them.

2. Your account

• You must be at least 18 years old.
• You must give accurate information and keep your email address current — we use it for receipts, verification and account notices.
• You are responsible for keeping your password secure and for everything done through your account.
• One person, one account. Creating multiple accounts to obtain additional free credits or to manipulate the affiliate programme is not permitted.

3. Plans and payment

Plans are billed in Philippine Pesos. Current pricing, credit allocations and included features are shown on the Plans page, which forms part of these terms.

Manual payment and approval

Payments are made manually — you send payment by GCash or bank transfer and upload proof of it. Your plan or credits are activated only after we verify that payment. Verification is done by a person, so there is a delay between paying and activation. We aim to review promptly but do not guarantee a specific turnaround time.

If we cannot verify a payment, we will reject it and email you the reason. You may correct the details and submit again.

Renewals

Because payment is manual, nothing is charged automatically. Your plan does not auto-renew — you choose whether to pay again at the end of each period. When a plan lapses, your account reverts to the Free tier. Your saved projects are not deleted, but features limited to a paid plan stop working.

4. Credits and refunds

• Each generation costs a set number of credits, shown in the interface before you run it.
• Credits have no cash value, cannot be transferred between accounts, and cannot be exchanged for money.
• If a generation fails because of a fault on our side, contact us and we will restore the credits.
• Payments for plans and credit top-ups are non-refundable, except where a refund is required by law, or where we have charged you in error.
• We may adjust how many credits a feature costs as our own costs change. Any increase applies only to future generations.

5. Acceptable use

You agree not to use CreaCio to:

• Break any law, or infringe anyone's intellectual property or privacy rights.
• Create content that is deceptive, defamatory, hateful, harassing, sexual, or that promotes violence or self-harm.
• Make false or misleading claims about a product, including invented health, safety or performance claims.
• Impersonate any person, brand or business.
• Generate imagery of real people, including yourself, other creators, or public figures.
• Attempt to bypass credit limits, plan restrictions, or any technical control.
• Scrape, resell, or provide access to the service to others as if it were your own.
• Interfere with the service's operation or attempt to gain unauthorised access to it.

6. What you may upload

By uploading an image you confirm that:

• It shows a product, not a person.
• You have the right to use it — you took it, you own it, or the rights holder has permitted you to use it.
• You are not uploading a photo of any identifiable person without their explicit consent, and you are never uploading a photo of a child.

We apply automated checks that reject uploads which do not appear to contain a product. These checks reduce misuse but do not catch everything, and passing them is not our approval of your upload. The responsibility for what you upload remains yours.

Uploading imagery of people, particularly of minors, will result in immediate termination of your account and may be reported to the authorities.

7. AI-generated output

Ownership

You own the content you generate and may use it commercially, including in your affiliate promotions.

What we cannot promise

• Accuracy. AI output can be wrong. Generated copy may state product features, measurements or benefits that are inaccurate. Check every claim against the actual product before you publish. You are responsible for what you post.
• Uniqueness. Similar prompts can produce similar results for different users. We cannot guarantee your output is unique to you.
• Consistency. The same input may produce different results on different runs.
• Platform acceptance. Shopee, TikTok and other platforms have their own rules about AI-generated content and disclosure. Complying with them is your responsibility, and generated images may carry invisible provenance markers identifying them as AI-generated.

8. Bio pages

• Bio pages are available on paid plans and are published at creacio.co/u/<username>.
• A bio page is public. Anything you put on it can be seen by anyone.
• Usernames are first come, first served. We may reclaim a username that impersonates a person or brand, or that is used misleadingly.
• You may only link to the sites on our approved list. This protects every CreaCio bio page — if scam links were published on our domain, browsers would block the entire domain and every user's page with it.
• We may suspend any bio page that breaches these terms, without notice.
• You are responsible for the content of your page and for the destinations you link to.

9. Affiliate programme

• Paid plans earn commission on referrals at the rate shown for your plan on the Plans page.
• Commission is earned when a person you referred makes a qualifying payment.
• Commission is only payable while your own plan is active.
• Payouts are available once your balance reaches the stated minimum.
• Self-referral, referring accounts you control, and any other manipulation forfeits all commission and may result in termination.
• We may withhold a payout while we investigate suspected abuse, and may reverse commission relating to a payment that is refunded or reversed.
• You are responsible for any tax due on commission you receive.

10. Availability and changes

We work to keep CreaCio available but do not guarantee uninterrupted service. Features depend on third-party AI providers, and if a provider changes or withdraws a model, a feature may change or stop working.

We may add, change or remove features. If we remove something material to a paid plan, we will give you reasonable notice.

We may update these terms. Material changes will be notified by email or in the service before taking effect. Continuing to use CreaCio after that means you accept the updated terms.

11. Suspension and termination

You may stop using CreaCio at any time and ask us to close your account.

We may suspend or terminate your account if you breach these terms, if we reasonably suspect fraud or abuse, or if required by law. Where a breach is serious — in particular uploading imagery of minors — we will act immediately and without notice.

On termination, access to paid features ends. We do not refund unused credits or plan time where termination follows a breach on your part.

12. Liability

CreaCio is provided "as is". To the fullest extent permitted by law, we exclude implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for indirect or consequential loss, including lost profits, lost sales, lost affiliate commission from any platform, loss of data, or the consequences of a platform removing your content or account.

Where liability cannot be excluded, our total liability to you is limited to the amount you paid us in the three months before the event giving rise to the claim.

Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence.

13. Governing law

These terms are governed by the laws of the Republic of the Philippines, and the courts of the Philippines have exclusive jurisdiction over any dispute.

If any provision is found unenforceable, the rest remains in force.
